                               为境内外国就业者参加社会保险护航
 

    本月的早些时候,中国政府公布了境内外国就业者参加中国社会保险计划的暂行办法,该办法将于下月15日,也就是10月15日正式试行。自此,境内外国就业者依法参加社会保险和享受社会保险待遇有了明确的法律依据。

 该办法明确了外国就业者依法参加社会保险和享受社会保险待遇的权利,也就是说用人单位和其外籍员工必须按照法律规定缴纳社会保险费、参加中国的社会保险计划,这也在一定程度上体现了对用人单位的强制性约束。该办法的第三条明确了缴费的义务主体,即用人单位和本人按照规定缴纳社会保险费,其中的用人单位是指在境内依法注册或登记的企事业单位、社会团体以及其他可以合法招用外籍员工的组织。

 以上提到的是在境内为中国企业或组织工作的外籍员工的社会保险问题。对于受境外雇佣合同约束的外籍员工,在其被派遣到在中国境内注册或者登记的分支机构、代表机构工作的,也必须依法参加中国的社会保险计划。其缴费主体是本人和分支机构或代表机构。

 关于外籍员工的参保范围问题,根据该办法除了住房公积金以外,其他国人所享有的社会保险计划外籍员工均有权享受。所谓住房公积金指的是用人单位及员工缴存的长期住房储金,以应对涉及有关住房的各方面风险。具体来讲,该办法所允许的外籍员工参加社会保险计划的范围包括:基本养老保险、职工基本医疗保险、工伤保险、失业保险和生育保险。需要再次明确的是,住房公积金不属于以上范围。

 从程序上来看,境内用人单位聘用外籍员工应当自办理就业证件之日起的30日内为其办理社会保险登记。境外用人单位派遣外籍员工到其在中国设立的分支机构或者代表机构工作的,也必须按照以上规定的程序期限为外籍员工办理社会保险登记。

 当参加社会保险的外籍员工符合获取相应社会保险待遇的条件时,即有权依法享受社会保险待遇。当然,有一种情况是如果外籍员工在达到规定的领取养老金年龄前离境了,其养老保险金应当如何处理呢?根据该办法此种情况下本人可以根据自身的情况从两个选择中做出最符合自身的选择:第一种选择是保留社会保险个人账户,等下次来中国时再继续缴费,以累计计算养老保险金;第二种选择是通过本人的书面申请以终止社会保险关系,并一次性领取社会保险计划个人账户中的储存额。当然,究竟采取何种方式需要本人根据自身的情况对该办法所提供的以上两种选择做出最终选择。

 关于该办法的具体实施我们期待着地方政府及其劳动部门实施细则的尽快出台,以使该办法的作用能在实践中发挥更好的效果。

该办法首规定在中国境内就业的外国人有权参加社会保险和享有社会保险待遇。具体而言,该办法规定如下:
1)在中国境内依法注册或者登记的企业、事业单位、社会团体、民办非企业单位、基金会、律师事务所、会计师事务所等组织(以下称用人单位)依法招用的外国人,应当依法参加社会保险,由用人单位和本人按照规定缴纳社会保险费
2)与境外雇主订立雇用合同后,被派遣到在中国境内注册或者登记的分支机构、代表机构(以下称境内工作单位)工作的外国人,应当依法参加社会保险,由境内工作单位和本人按照规定缴纳社会保险费。
   (上述社会保险包括职工基本养老保险、职工基本医疗保险、工伤保险、失业保险和生育保险)
    用人单位招用外国人的,应当自办理就业证件之日起30日内为其办理社会保险登记。受境外雇主派遣到境内工作单位工作的外国人,应当由境内工作单位按照前款规定为其办理社会保险登记。
    在达到规定的领取养老金年龄前离境的,其社会保险个人账户予以保留,再次来中国就业的,缴费年限累计计算;经本人书面申请终止社会保险关系的,也可以将其社会保险个人账户储存额一次性支付给本人。外国人死亡的,其社会保险个人账户余额可以依法继承。
    具体关于外国人如何参加社会保险还有待地方有关政府部门进一步规定。

    该公告指示为进一步促进贸易便利化,加强货物贸易外汇管理,上述国家机关决定改革货物贸易外汇管理制度、优化升级出口收汇与出口退税信息共享机制,自实施日期起,在江苏、山东、湖北、浙江(不含宁波)、福建(不含厦门)、大连、青岛地区试点。
试点期间,试点地区企业不再办理出口收汇核销手续但应依照试点相关规定。试点地区外汇局根据企业贸易外汇收支合规性,将企业分为以下三类。
1) A类:进口付汇单证简化,可凭进口报关单、合同或发票等任何一种能够证明交易真实性的单证在银行直接办理付汇,出口收汇无需联网核查;银行办理收付汇审核手续相应简化.
2) B类:B类企业贸易外汇收支由银行实施电子数据核查
3) C类: C类企业贸易外汇收支须经外汇局逐笔登记后办理。

    该通知对外商独资船务公司申请设立的程序进行了明确的规定。同时明确了外商独资船务公司的审批机构和业务管理部门,即交通运输部和省级商务主管部门是外商独资船务服务公司的审批机构,交通运输部和省级交通运输主管部门是独资船务公司的业务管理部门。该通知同时指出为了促进我国船运事业的发展,应适当放宽独资船务公司市场准入条件和经营范围

          Earlier this month, the Chinese Government announced plans to accept foreign workers into the country’s social insurance program. The law embodying these plans comes into force next month on October 15th.


         This development means that foreigners working in China have the right to participate in the country’s social insurance programs and enjoy social insurance treatments. The new rule requires enterprises, public institutions, social organization and others lawfully employing foreigners in China to participate in social insurance, with companies and employees contributing accordingly.

         Foreigners dispatched by foreign companies to work in China at their local branches or representative offices must also participate in social insurance, with local branches or representatives offices contributing along with employees.

         The scope of social insurance coverage envisioned for foreign workers in the new rule include all elements of social insurance coverage for a typical Chinese national except the participation in the housing provident fund (a long term reserve fund under employee name for purpose of paying employee housing related expenses). Specifically, the new rule allows foreigners to participate in the basic old age pension, basic employee medical insurance, work-injury insurance, unemployment insurance and maternity insurance programs. As stated, contribution into the housing fund is so far not available to foreign workers.

        Procedurally, local employers employing foreigners must process foreign employee’s social insurance registration within 30 days of applying for work visa for the same worker. Local branches or representative offices receiving workers dispatched from overseas must also register workers received within the same period.

       If foreign workers depart China before becoming eligible to receive old age pension, his or her individual social insurance account is kept and will continue to accumulate if he or she returns to work in China again. In case a foreigner determines he or she will not likely ever return to China to work, foreign worker may also apply in writing to terminate social insurance and the balance in the individual social insurance account may be paid to the foreign individual in one lump-sum.

        Specific measures to implement foreigner social insurance participation will be announced by relevant local government or labor departments.

      The measure states that foreigners working in China have the right to participate in social insurance and enjoy social insurance treatments. Specifically, the Measure requires that:
      1) Enterprises, public institutions, social organization, non-state non-enterprise companies, foundations, law firms, accounting firms and other organization (“Employing Unit”) lawfully employing foreigners must participate in social insurance in accordance with the law, with Employing units and employees contributing accordingly.
     2) Foreigner employees signing employment contract and subsequently dispatch to China to work for branches or representative offices (“Work Unit”) must participate in social insurance in accordance with the law, with Work Unit and employees contributing accordingly
     (“Social Insurance” described include basic employee old age pension, basic employee medical insurance, work-injury insurance, unemployment insurance and maternity insurance).
     Employing Unit employing foreigners must process foreign employees’ social insurance registration within 30 days of applying for work visa for the same worker. Work Units must process foreign workers dispatch to Work Unit within China for social insurance registration according to the rules stated.
     If foreigners depart China before becoming eligible to receive old age pension in accordance with the law, his or her individual social insurance account is kept and will continue to accumulate if he or she works in China again; Foreigner may also apply in writing to terminate social insurance and the balance in the individual social insurance account may be paid to individual in one lump-sum. If foreigners die, his or her individual social insurance account balance becomes part of the estate.
    Specific measures to implement foreigner social insurance participation will be announced by local relevant local government or labor departments.  I

    The announcement indicates that in order to further enhance trade simplification as well as improve trade related foreign exchange management, the four state agencies have embarked to reform trade related foreign exchange management system to improve and upgrade information sharing capabilities in relation to export foreign exchange receipt and export tax refund on a trial basis. Commencing on the implementation date, reform trial will begin in the selected area of Jiangsu, Shandong, Hubei, Zhejiang (not including Ningbo), Fujian (not including Xiamen), Dalian and Qingdao.
    During trial period, selected trial area enterprises are exempted from applying for export foreign exchange receipt confirmation but must rely on reform trial rules. Trial area foreign exchange bureaus shall organize enterprises into the following three categories based on the properness of enterprise foreign exchange acceptance and payment:
    1) Category A: Simplified import foreign exchange payment receipt – may rely on import custom report, contract, invoice and other document capable of evidencing trade transaction to apply directly for foreign exchange payment at banks and export foreign exchange receipt requires no online verification; banks processing foreign exchange receipt verification procedural shall be equally simplified.
   2) Category B: Banks must implement electronic data verification for category B enterprise foreign exchange payment and receipt from trade.
   3) Category C: Foreign exchange bureaus must be processed case by case foreign exchange payment and receipt for category C enterprises engaging in trade

To carry out “overseas investment” development policy from the "Twelfth Five-Year Plan", relevant departments issued this guideline. The Investment environments of 115 countries have been introduced in this guideline. The main contents are as follows: Major Industrial Development Goals, Priority Industries, Key Industries and others. A List of countries that have signed the Foreign Bilateral Investment Protection Agreement and Avoidance of Double Taxation Agreement with China are also included in this guideline.

This announcement clearly defines procedures for the establishment of wholly foreign-owned shipping company, as well as clarifies, the relevant approving authority and the management authority. According to this announcement, the Ministry of Transport and the provincial commerce department are defined as the approving authority. The Ministry of Transport and the provincial transport authority are defined as the management authority. Also, for promoting the development of China’s shipping industry, market access conditions will be relaxed and business scope will be expanded..
